The definition of a short term rental, known in state statutes as "Transient Commercial Use" is one that is less than 30 days. These kind of rentals are handled differently by state law.
Just about every condo in Incline Village is part of a homeowner's association, which has a set of CCR's (Covenants, Conditions and Restrictions). Sometimes, this document spells out whether or not short term rentals are allowed. The first document that should be checked is the CCR's to make sure there are no restrictions or for specific language allowing short term rentals, or rentals less than 30 days. Does it mean if the CCRs don't restrict short term rentals that they are allowed?
No.
Some real estate agents don't realize that it's important to ask for something that actually documents the homeowner policy on short term rentals. If the CCRs don't mention short term rentals, the HOA board can vote to restrict or allow them. It's important to get this information in writing so you don't rely on verbal sources before you decide on a purchase of a condo you wish to rent out as a short term rental.
